The BAMF is once again deciding on asylum applications from refugees from Gaza. This was confirmed by the Federal Office for Migration and Refugees (BAMF) at the request of tuenews INTERNATIONAL. Media such as “Tagesschau” and “Spiegel” had previously reported on this. The background to this was a small question from the Left Party parliamentary group in the Bundestag.
“The Federal Office for Migration and Refugees has continuously monitored the situation in the Gaza Strip and has come to the conclusion that due to the duration, the failure of several agreements on a call to arms and the expansion of the fighting to the entire territory of the Gaza Strip, it can no longer be assumed that the situation is only temporarily uncertain in accordance with Section 24 (5) of the Asylum Act (AsylG),” the authority continued. Since the beginning of 2024, the BAMF had halted decisions on asylum applications from people from Gaza and justified this by stating that the situation there was “temporarily uncertain” in accordance with the Asylum Act.
Die Linke attributes the change to the fact that there had been several complaints against this practice. From October 2023 to April 30 of this year, courts had ruled on 238 complaints of inactivity by refugees from Gaza or Palestinian territories, explains the Left Party parliamentary group. In 187 cases, the BAMF had been obliged to decide on the asylum applications, and in three cases the courts themselves had ordered subsidiary protection. 48 proceedings have been discontinued.
