Syrian refugees are still unable to travel to their old homeland without risk. This was confirmed by the Federal Office for Migration and Refugees (BAMF) at the request of tuenews INTERNATIONAL. It therefore remains the case that only Syrian refugees who have now received a German passport can go on an exploratory trip to their old homeland without jeopardizing their protection status and thus their right of residence. This means that there are still few opportunities to travel to Syria to check whether a new start would be possible there. “In the view of the Federal Ministry of the Interior, it is not possible to guarantee that Syrians entitled to protection will not travel home, contrary to this legal presumption, especially in view of the fact that the BAMF has already partially resumed its decision-making activities for criminals and persons posing a risk,” the BAMF continued.
Government rejects new regulation
“According to the current legal situation, it is generally assumed that the requirements for the respective protection status are no longer met in accordance with Section 73 (7) of the Asylum Act if travel to the country of origin is not morally imperative,” the BAMF continues. Exceptions are possible if, for example, a family member is seriously ill. In January of this year, the previous government had considered allowing such fact-finding trips. However, the new federal government has not pursued the idea any further.
